A Binding Financial Agreement under the Family Law Act 1975 requires each partner to receive independent legal advice from a separate solicitor. Prenuply facilitates this process but does not provide that advice. The legal advice you receive from your solicitor is separate from Prenuply's document preparation service.
No guarantee of enforceability
While Prenuply's process is designed to support the legal requirements for a Binding Financial Agreement, we cannot guarantee the enforceability of any agreement. Enforceability depends on the specific circumstances of the parties, the accuracy of financial disclosure, the quality of legal advice received, and other legal factors outside Prenuply's control.
Suitability
Not every situation is suitable for the Prenuply process. If your matter involves complexity that requires bespoke legal representation, we will tell you. It remains your responsibility to obtain appropriate legal advice for your circumstances.
Not a substitute for legal counsel
Nothing in the Prenuply platform substitutes for the advice of a qualified solicitor. We strongly encourage both partners to engage actively with their respective lawyers and to ask questions until they genuinely understand the agreement they are signing.
