Prenuply is built around fairness, transparency, and careful process. Some matters require closer attention. Here is how we approach that.
Privacy
All financial and personal information collected through Prenuply is treated as strictly confidential. Information is used only for the purpose of preparing your Binding Financial Agreement and coordinating the legal advice process.
Prenuply uses secure systems to store and transmit sensitive data. We do not sell or share your information with third parties other than the lawyers involved in your matter. See our Privacy Policy for full details.
Suitability
Not every situation is suited to the standard Prenuply process. The questionnaire includes questions specifically designed to identify matters that may need closer attention or a different approach.
If your matter involves any of the following, we will communicate that clearly so you can make an informed decision about how to proceed.
Situations requiring closer review
Coercion or Pressure
A valid BFA requires that both partners enter it freely and voluntarily. If either partner feels pressured, the agreement may not be appropriate at this time.
Significant Power Imbalance
Where one partner has substantially greater financial knowledge or bargaining power, additional care and independent advice becomes especially important.
Complex Entity Structures
Businesses held through companies, trusts with multiple beneficiaries, or complex family arrangements may require a more detailed legal review beyond the standard process.
International Assets
Assets held overseas, or situations where one or both partners are not Australian residents, may involve additional legal considerations.
Incomplete Financial Disclosure
If either partner is uncertain about the value or existence of assets, or is unwilling to provide full disclosure, a valid agreement cannot be properly prepared.
Family Violence Concerns
If there is any history of family violence or safety concerns, Prenuply is not the right process. Please seek independent legal advice and appropriate support.
Transparency
Prenuply is designed to make the process clearer and more accessible — not to oversimplify important legal issues. We are honest about the limits of what an online process can and cannot do.
Independent legal advice from qualified solicitors is a genuine legal requirement, not a formality. Each partner speaks with their own lawyer who provides real, personalised advice before the agreement is signed.
If something does not feel right
If at any point either partner has concerns about the process, please do not proceed. Reach out to us at hello@prenuply.com.au and we will help you understand your options. A refund may be available if the matter is determined to be unsuitable after intake review.
